These terms apply when you buy goods from Gearpress through gearpress.co.uk.
Please read them before placing an order.
1. About Gearpress
Gearpress is a trading name of DEV MUSE LIMITED, a company registered in
England and Wales under company number 16044300. Our registered office is
Unit 22 Cariocca Business Park, 2 Sawley Road, Manchester, England, M40 8BB.
You can contact us at
support@gearpress.co.uk.
2. Products
We take reasonable care to describe and show each product accurately.
Screens, garment batches and printing processes can cause small differences
in colour, size and print position. These reasonable differences do not
affect your legal rights if an item is faulty, damaged or not as described.
Most Gearpress products are printed after you order. “Printed to order” does
not by itself mean that an item is personalised or excluded from the normal
cancellation right described below.
3. Prices and payment
Prices are shown in pounds sterling and include any VAT that applies.
Delivery charges are shown before you place the order. Payment is handled
securely by the payment service offered at checkout. We do not receive or
store your full card details.
4. Placing an order
Your order is an offer to buy the items in your basket. After you place it,
we will send an acknowledgement. A contract is formed when we accept the
order and confirm that it is being processed. If we cannot accept an order,
we will tell you and refund any payment taken.
Please check product, size, colour, delivery address and contact details
before submitting the order. Contact us promptly if you notice an error. We
cannot promise to change an order after production has begun.
5. Production and delivery
Estimated production and delivery times are shown during the order process
where available. They are estimates, not guaranteed dates. We will deliver
without undue delay and, unless another period is agreed with you, within 30
days after the contract is formed.
If a delay is outside our reasonable control, we will contact you and take
reasonable steps to reduce its effect. Your legal rights for serious delay
are not affected.
Responsibility for the goods passes to you when they are delivered to you or
to a person you nominate. You own the goods once we have received payment in
full.
6. Changing your mind
For standard catalogue goods bought online, you normally have 14 days after
the day you receive them to tell us that you wish to cancel. If one order
arrives in separate deliveries, the period runs from the day after the final
item arrives.
Email
support@gearpress.co.uk with
your order number and a clear statement that you wish to cancel. You then
have a further 14 days to send the goods back.
You may inspect an item as you would in a shop. We may reduce a refund if
handling beyond that has reduced its value. You are responsible for the
direct cost of returning a change-of-mind item unless we agree otherwise.
7. Personalised goods
The cancellation right does not apply to goods made to your specification or
clearly personalised. We will state this clearly before purchase where it
applies. It does not apply merely because a standard catalogue item is
printed after ordering.
8. Faulty, damaged or incorrect goods
Goods must be as described, fit for purpose and of satisfactory quality. If
an item arrives damaged, faulty or incorrect, contact us as soon as
practical with your order number and photographs where useful. We will
explain the available repair, replacement or refund route and cover
reasonable return costs where the law requires us to do so.
Nothing in these terms limits your rights under the Consumer Rights Act 2015
or other mandatory consumer law.
9. Refunds
For a valid change-of-mind cancellation, we will refund the item price and
the standard outbound delivery charge. We do not have to refund an upgrade
above the least expensive standard delivery method offered.
We will make the refund without undue delay and no later than 14 days after
we receive the returned goods or evidence that you sent them, whichever is
earlier. If no goods were supplied, we will refund within 14 days after you
tell us you are cancelling. Refunds are made to the original payment method
unless we agree otherwise.
10. Events outside our control
We are not responsible for delay caused by events outside our reasonable
control, but we remain responsible for taking reasonable steps, keeping you
informed and meeting your mandatory legal rights.
11. Liability
We do not exclude or limit liability where doing so would be unlawful,
including liability for death or personal injury caused by negligence,
fraud, or breach of your statutory consumer rights. We are not responsible
for business losses arising from a consumer purchase.
12. Intellectual property
The artwork, product designs, text and branding on this site belong to
Gearpress or are used with permission. Buying a product does not transfer
any intellectual property rights.
13. Law and disputes
These terms are governed by the law of England and Wales. If you live
elsewhere in the UK, you keep the protection of any mandatory law that
applies where you live and may bring proceedings in your local courts.
Please contact us first so we can try to resolve a problem directly.
